WithinEHR provides software solutions designed to enhance the management of electronic medical records (EHR), healthcare workflows, and patient interactions. We reserve the right to modify, suspend, or discontinue any part of our services without notice. You agree that we are not liable to you or any third party for such modifications or discontinuations.

3. User Account

To access certain features, you may be required to register an account. You agree to:

  • • Provide accurate and up-to-date information.
  • • Maintain the security and confidentiality of your account credentials.
  • • Notify us immediately of any unauthorized use of your account. You are solely responsible for all activities that occur under your account, including any actions taken by third parties to whom you have granted access.

4. Subscription, Fees, and Payment Terms

• Subscription Plans: WithinEHR operates on a subscription basis with options for monthly or annual plans. By subscribing, you agree to the associated fees and terms.

  • • Billing and Payment: Payments are due at the beginning of each subscription period and are non-refundable except as required by law. Failure to pay may result in suspension or termination of services.
  • • Changes to Pricing: We reserve the right to change subscription fees, giving prior notice of at least 30 days. Your continued use after the change signifies acceptance of the new pricing.

5. License and Intellectual Property

WithinEHR grants you a limited, non-exclusive, non-transferable license to use our software in accordance with these Terms. All content, features, and intellectual property associated with the software, including but not limited to logos, designs, and code, are owned by WithinEHR or its licensors. Unauthorized use or reproduction is prohibited.

6. User Conduct

You agree not to:

  • • Use the services in any manner that violates local, state, national, or international laws.
  • • Engage in fraudulent activities or distribute malware, viruses, or any harmful content.
  • • Interfere with, disrupt, or compromise the integrity of our software or its associated systems.

7. Data Protection and Privacy

WithinEHR prioritizes the security and confidentiality of your data. We employ industry-standard safeguards to protect personal and sensitive information. However, we cannot guarantee absolute security and are not liable for unauthorized access, hacking, data loss, or similar breaches.

8. Indemnification

You agree to indemnify and hold WithinEHR, its affiliates, employees, and agents harmless from any claims, damages, liabilities, or expenses arising from your violation of these Terms or misuse of our services.

9. Limitations of Liability

To the maximum extent permitted by law, WithinEHR shall not be liable for any Direct or indirect, incidental, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of or inability to use the services.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Texas, USA.

11. Changes to Terms

We may revise these Terms from time to time. We will notify you of changes via email or within the software. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
